Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Nailing.AI platform ("Service"). By using the Service, you agree to these terms.

2. Service Description

Nailing.AI is an AI-powered research and content planning tool for content creators. Our service includes:

Canvas-based content planning
AI-powered writing and analysis
Video transcription and analysis
Competitor content analysis
Note-taking and organization

3. Account Creation

You must be 18 years or older to create an account
You must provide accurate and current information
You are responsible for your account security
Each user may only create one account
You may not share your account with others

4. Acceptable Use

When using our platform, you may not:

Create or share illegal content
Violate others' copyrights
Spread spam, malware, or harmful content
Compromise the platform's security
Create excessive load with automated tools
Harass other users
Produce misleading or fake content
Reverse engineer our services

4.1 Fair Use of Resource-Intensive Features

Some features — including video transcription/analysis and competitor analysis — are resource-intensive. To keep the service healthy for everyone and to prevent abuse (such as automated bulk processing or unusually high volume), these features are subject to reasonable fair-use limits. Normal use is not affected; unusually heavy use may be rate-limited or may consume additional credits. We may adjust these limits without prior notice to protect service quality, and we will show a clear message if a limit is ever reached.

5. Content Ownership

5.1 Your Content

Content you create on the platform (canvases, notes, text) belongs to you. We only access this content to provide the service.

5.2 AI Outputs

You have commercial rights to AI-generated content. However, you acknowledge that the same outputs may be generated for other users.

5.3 Feedback

We have the right to use feedback and suggestions you provide to improve the service.

5.4 Content You Upload or Import

You may upload files and videos, or import content from third-party services you connect (such as Google Drive or Notion). You are responsible for ensuring you hold the necessary rights to that content, and you grant us a limited right to store and process it solely to provide the service. You must not upload or import content that is illegal or that infringes the rights of others.

6. Payments, Subscriptions & Refunds

6.1 Subscriptions

Paid plans are billed monthly or annually via Stripe. Subscriptions automatically renew at the end of each billing period unless cancelled.

6.2 Credits (Subscription & Packs)

(a) Subscription credits. Each plan allocates a defined number of credits per billing period (monthly or yearly). Unused subscription credits are reset to zero at the end of every renewal period; the new period's quota is granted fresh. This is the standard "use-it-or-lose-it" model used by common AI services such as ChatGPT and Claude.

(b) On cancellation. If you cancel your subscription, you retain full access to all features until the end of the current billing period. When that period ends, any remaining subscription credits are reset to zero. If you resubscribe, the new period's quota is granted fresh.

(c) Credit packs. Optional credit packs purchased separately are independent of any subscription. Pack credits never expire and are preserved if your subscription is cancelled or not renewed. You may purchase packs without holding an active subscription.

(d) Spending order. When an AI operation is performed, subscription credits are deducted first, followed by pack credits.

(e) Transitional clause (subscribers before May 1, 2026). For users who subscribed before May 1, 2026 (UTC), unused subscription credits at the end of a period following cancellation remain locked in the account rather than being reset to zero, and become spendable again upon resubscription. This grand father clause may only be terminated with at least 30 days' prior notice by email.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain full access until that date. The treatment of remaining subscription credits at period end is governed by Section 6.2.

6.4 Refund Policy

Monthly plans: No refunds. Cancellation takes effect at period end.

Annual plans: Full refund available within 14 days of subscription start, regardless of credit usage. After 14 days, no refund is issued but access continues until the end of the annual period.

Credit packs: Non-refundable once any credits have been consumed.

6.5 Right of Withdrawal (EU/Turkey)

By completing a purchase, you request immediate access to the service and acknowledge that you may waive your statutory right of withdrawal once the service has been accessed, in accordance with EU Consumer Rights Directive and Turkish Consumer Protection Law (No. 6502).

7. Service Interruptions

Service may be interrupted due to maintenance, updates, or unexpected issues. We try to provide advance notice for such situations but do not guarantee it.

8. Limitation of Liability

Our service is provided "as is". We do not accept liability for:

Data loss or damage
Business loss or profit loss
Accuracy of AI outputs
Issues with third-party services
Problems caused by user errors

9. Account Suspension and Termination

We may suspend or terminate your account for:

Violation of these terms
Suspected illegal activity
Extended inactivity (12 months)

10. Changes

We may update these terms from time to time. We will notify you of significant changes at least 30 days in advance via email. Continued use of the service after changes means you accept the new terms.

11. Dispute Resolution

Disputes arising from these terms are subject to Turkish law and the courts of Istanbul have jurisdiction. We will first seek amicable resolution.

12. General Provisions

Invalidity of any part of these terms does not affect other parts
Failure to exercise our rights does not mean we waive them
These terms constitute the entire agreement between us
